The Importance of Immigration Evaluations in Legal Proceedings

If you or a loved one is facing immigration legal proceedings, you may have heard of an immigration evaluation. But what is it, and why is it important? In this article, we'll answer these questions and provide you with all the information you need to understand the value of immigration evaluations.

Immigration evaluations are clinical assessments conducted by licensed mental health professionals. These evaluations are critical pieces of evidence in immigration cases, as they provide a detailed description of an individual's mental and emotional state. The purpose of the evaluation is to provide evidence for immigration cases, which can determine the fate of individuals and their families.

Why Is an Immigration Evaluation Important?

Immigration evaluations can be the deciding factor in immigration cases and carry immense value and impact. The evaluation can determine whether someone is deported to life-threatening circumstances, whether a family is split apart, and whether an individual receives protection under the law. The evaluation process results in a thorough written assessment, which can be between 12-15 pages depending on the type of evaluation. The assessment provides a detailed description of the individual's psychological and emotional state and is a critical piece of evidence in immigration proceedings.

Immigration evaluations are provided for a variety of cases

  • Asylum cases: Immigration evaluations can provide psychological reasons why a client missed the one-year filing deadline and detail how PTSD symptoms provide evidence of the persecution they suffered.
  • Extreme hardship cases: Immigration evaluations can identify unique factors contributing to a client's psychological distress, such as illness, disability, professional, financial, or academic hardship, or adverse home-country conditions that would affect the petitioner or their family members.

This also includes where the government wants to deport a family member back to their home country and it would cause a hardship on the American Citizen. In this case, the client would be the American Citizen.
  • VAWA cases: Immigration evaluations can detail the client's psychological symptoms, which are common for domestic violence victims, assess credibility, and, where useful, explain uncommon phenomena such as ways in which men are abused by female partners.
  • T-Visa and U-Visa cases: Immigration evaluations can detail the client's psychological symptoms, which are common for human trafficking, abduction, extortion, attempted murder, and more. The evaluation can assess credibility and describe how the immigrant has suffered substantial mental or physical abuse.

How Immigration Evaluations Are Conducted

Immigration evaluations typically involve two sessions, each lasting approximately 1 to 1.5 hours. These sessions can be conducted online or in-person, depending on the individual's preference and availability. During these sessions, the mental health professional will assess the individual's psychological and emotional state and gather information about their history and current circumstances.

The timeframe for an immigration evaluation is typically around 3 to 4 weeks. If there is a need for an expedited evaluation, an additional fee for a rush service will be assessed depending on how fast the turnaround is. The therapist's fee for an immigration evaluation is $1200.

Immigration evaluations are critical pieces of evidence in immigration cases. They provide a detailed description of an individual's psychological and emotional state and can be the deciding factor in immigration proceedings. If you or a loved one is facing immigration legal proceedings, consider obtaining an immigration evaluation from a licensed mental health professional.
